TERMS AND CONDITIONS, CODE OF CONDUCT & RELEASE OF LIABILITY

It is a condition of entry to Harper’s Cottage, whether as the booker or guest of person booking, that you read and agree to comply with the terms of this document, which sets out our policies concerning your stay.
Guest identity must be verified prior to stay, through presentation of a valid driver’s license or via the online service like Superhog.
Whilst Harper’s cottage strives to offer the best possible stay, it is neither a hotel nor staffed BnB, but a private residence (our home) that is operated as a short term rental property. We want you to feel like you have been invited for a stay at a friend’s fabulous country cottage and would appreciate if you treated it with the same respect you would naturally show when staying at a private residence.
All reservations have to be pre-paid and are non-refundable in case of cancellations (after 14 days within the arrival date). For that reason we recommend you take out appropriate travel insurance for cover against any unexpected travel costs.
Within the cottage grounds there is a car park that is available for guests to use free of charge. Cars are parked at the owner’s risk.
Normal check in time is 3pm, where possible we will try to accommodate early arrival requests but it is not always possible.
The cottage needs to be vacated by 11am on the day of departure (to facilitate the cleaning of the room).
Shower/bath gel, hand soap and shampoo and conditioner is provided. A hairdryer is also provided. We kindly ask that you do not take them with you when you depart.
Remember that water is precious and with Harper’s Cottage Malmbsury only on tank water, so we kindly ask you do not waste water, particularly during the summer months. Harper’s Cottage Malmsbury also relies on power to drive the pumps for water to come from the tanks to the house, so if the power is out, there will be no running water until power is restored.
We understand accidents can and will happen so please report any damages asap. We do not normally charge for smaller breakages (eg. a glate or plate), but we reserve the right to charge for repair and making good if the damage is significant (over $100 in value).
We ask that you do not apply or use fake tan, sun creams, hair dyes or any dye product in our bedrooms and bathroom as they can damage linens, towels and soft furnishings. If professional cleaning is required to remove stains caused by the use of these products the cost will be passed onto you.
Tea and coffee making facilities are available and are provided free of charge.
Smoking is NOT permitted within any part of the cottages.
Complimentary WIFI is provided for guest use. Whilst every endeavour is made to ensure WiFi is working as intended, we cannot guarantee an available connection, as there may be network or satellite issues beyond our control. Particularly in country areas, outages do sometimes occur and whilst we will do everything they can to try to have the connection restored, it may not always be possible.
We are unable to accommodate pets so please do not bring them with you.
In consideration of you being permitted to enter cottage and its grounds, you hereby assume all risk of illness, accident and all risk of personal injury (including death) to yourself and to your personal property, sustained whilst you are in the property and its grounds and you and your heirs, executors, administrators, personal representatives and assigns hereby release us and our directors, officers and employees from any and all liability whatsoever for any loss, personal injury (including death) or property damage which you may suffer whilst in Harper’s Cottages and its grounds.
You hereby agree to hold harmless and indemnify us, our directors, officers, and employees, licensees, agents, assigns and successors against any and all claims, actions, proceedings, demands, liability, costs, losses, damages and expenses resulting from or by reason of any claim arising from a breach of any of your representations, agreement and undertakings made by you in this letter agreement.
The Guest confirms they have read and understand this agreement prior to accepting it, and are aware that by accepting this agreement are waiving certain legal rights which they or their heirs, next of kin, executors, administrators, assigns and representatives may have against Harper’s Cottage owners Kimberly Palmer and Darren Muir.
We reserve the right to amend these terms and conditions at any time.
